66);'>记者看到异物有别与饺子馅，呈规则的长方形，颜色橘黄色，能清晰的看到上面印有“黄山”两字，但异物长度却是有一般香烟过滤嘴的一半，疑似被切割过。</span><br style='outline: 0px;-webkit-tap-highlight-color: rgba(255, 255, 255, 15px;'>记者这袋猪肉韭菜水饺水饺的包装袋上看到，生产日期为20190121，生产日期后还有72A4的数字。2日中午，在永辉超市内，记者找到田先生当日所购的促销思念牌水饺，猪肉荠菜水饺和猪肉韭菜水饺用胶带固定在一起，而猪肉韭菜水饺的生产日期及日期后的数字与田先生拆开的猪肉韭菜水饺一致。</span></section><section><br></section><section 15px;'>对此，陕西恒达律师事务所高级合伙人、知名公益律师赵良善认为：消费者在超市购物，超市应该保障食品安全，在永辉超市所购买的水饺中吃出疑似烟头物，说明产品质量存在严重问题，而且，这些疑似烟头物将会危害到消费者的人身健康。因此超市销售上述问题水饺的行为违反了《消费者权益保护法》和《食品安全法》的相关规定。消费者要求赔偿损失外，还可以向生产者或者永辉超市要求支付价款十倍或者损失三倍的赔偿金；增加赔偿的金额不足一千元的，为一千元。</span><br 15px;'>对于民事赔偿后，仍觉得存在安全隐患的，可向工商管理部门投诉举报，工商部门可根据《消费者权益保护法》第五十六条：“经营者有下列情形之一，除承担相应的民事责任外，其他有关法律、法规对处罚机关和处罚方式有规定的，依照法律、法规的规定执行；法律、法规未作规定的，由工商行政管理部门或者其他有关行政部门责令改正，可以根据情节单处或者并处警告、没收违法所得、处以违法所得一倍以上十倍以下的罚款，没有违法所得的，处以五十万元以下的罚款；情节严重的，责令停业整顿、吊销营业执照：提供的商品或者服务不符合保障人身、财产安全要求的；”之规定，要求永辉超市作出整顿。</span><br
