font-family: "PingFang SC", "Hiragino Sans GB", "Microsoft YaHei", "WenQuanYi Micro Hei", "Helvetica Neue", Arial, sans-serif;"><strong style="letter-spacing: 0.544px;"><span class="wxart_image" wx-style="display:inline-block;text-align: center;white-space: normal;border-color: rgb(0, 0, 0);border-style: solid;border-width: 1px;box-sizing: border-box;"></span></strong></strong></p><section style="line-height: 2em;"><span style="font-size: 15px;text-align: justify;">经依法审查查明：</span><span style="font-size: 15px;">2020年4月至7月，被告人赵某某等人为获取非法获利，<font color="#ff0000">先后组织卖淫小姐在渭南市临渭区西四路某酒店、前进路某酒店1021、1023、1025、1029、1030、1031等房间进行卖淫活动。</font></span></section><section><br></section><section style="line-height: 2em;"><span style="font-size: 15px;">被告人赵某某通过建立微信群，对卖淫活动进行统一组织协调、安排成员分工，该赵负责招聘卖淫女，提供固定卖淫场所，规定上班时间和地点，雇佣人员负责拉客，为卖淫女提供客源，规定卖淫收入的分配比例，先由其收取嫖资后分配，统一采购性服务用品等行为，被告人王某某在卖淫活动中负责将客人带至小姐处挑选小姐，并介绍消费项目，就消费项目和客人进行商议，达成一致后收取费用（该费用统一转账至赵某某处），统一管理小姐需要的性服务用品，对卖淫者的卖淫活动直接进行安排、调度。</span></section><section><br></section><section style="line-height: 2em;"><span style="font-size: 15px;">被告人王某在卖淫活动中负责通过微信群发布招嫖广告，招揽嫖客，并将嫖客引导至指定酒店，为卖淫女提供客源。被告人张某某在卖淫活动中负责在酒店楼下将嫖客带至王某某处。</span></section><section><br></section><section style="line-height: 2em;"><span style="font-size: 15px;">被告人屈某某、苌某某、孙某某，为获取非法利益，</span><span style="font-size: 15px;color: rgb(171, 25, 66);">利用驾驶的陕E出租车拉载乘客之机，先后多次将有嫖娼意图的男乘客按照王某的要求，分别送到指定的嫖娼地点</span><span style="font-size: 15px;">，待双方达成交易后，王某根据客人消费套餐的标准，通过微信支付给相应的提成。</span></section><section style="line-height: 2em;"><span style="font-size: 15px;"><br></span></section><section style="line-height: 2em;"><span style="font-size: 15px;">临渭区法院认为，被告人赵某某、王某某为牟取非法利益，采用招募、雇佣、容留等方式，纠集、控制多人从事卖淫活动，其行为均已构成组织卖淫罪。</span><span style="font-size: 15px;">被告人王某、孙</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">、屈</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">、苌</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">、孙</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">为组织卖淫的被告人赵</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">、王</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">某</span><span style="font-size: 15px;">招募、运送嫖娼人员，其行为均已构成协助组织卖淫罪。</span></section><section><br></section><section style="line-height: 2em;"><span style="font-size: 15px;">被告人屈某某、苌某某、孙某某经公安机关电话传唤到案，在侦审期间亦能如实供述犯罪事实，系有自首情节，依法均可从轻处罚。被告人张某某、屈某某、苌某某、孙某某在案发后能主动退缴违法所得，依法可酌情轻处。</span></section><section><br></section><section style="line-height: 2em;"><span style="font-size: 15px;">综上，依法判决如下：</span></section><section style="line-height: 2em;"><span style="font-size: 15px;">一、被告人赵某某犯组织卖淫罪，判处有期徒刑五年六个月，并处罚金20000元。</span></section><section style="line-height: 2em;"><span style="font-size: 15px;">二、被告人王某某犯组织卖淫罪，判处有期徒刑五年，并处罚金15000元。</span></section><section style="line-height: 2em;"><span style="font-size: 15px;">三、被告人王某犯协助组织卖淫罪，判处有期徒刑三年四个月，并处罚金10000元。</span></section><section style="line-height: 2em;"><span style="font-size: 15px;">四、被告人张某某犯协助组织卖淫罪，判处有期徒刑二年，缓刑二年，并处罚金4000元</span></section><section style="line-height: 2em;"><span style="font-size: 15px;">五、被告人屈某某犯协助组织卖淫罪，判处有期徒刑一年七个月，缓刑二年，并处罚金3000元。</span></section><section style="line-height: 2em;"><span style="font-size: 15px;">六、被告人苌某某犯协助组织卖淫罪，判处有期徒刑一年五个月，缓刑二年，并处罚金3000元。</span></section><section style="line-height: 2em;"><span style="font-size: 15px;">七、被告人孙某某犯协助组织卖淫罪，判处有期徒刑一年四个月，缓刑二年，并处罚金2000元。</span></section><section style="line-height: 2em;"><span style="font-size: 15px;">八、被告人张某某、屈某某、苌某某、孙某某退缴的违法所得共计2400元，由公安机关依法予以没收。</span></section><section style="line-height: 2em;"><span style="font-size: 15px;">九、被告人赵某某违法所得54551元、被告人王某某违法所得35852元、被告人王某违法所得33645元，依法予以追缴，追回后依法予以没收。</span></section><section style="line-height: 2em;text-align: center;"><span style="font-size: 11px;">（来源：中国裁判文书网、12309中国检察网）</span><br></section><p style="font-family: -apple-system, BlinkMacSystemFont, "Helvetica Neue", "PingFang SC", "Hiragino Sans GB", "Microsoft YaHei UI", "Microsoft YaHei", Arial, sans-serif;
