深圳一男子醉倒路边被流浪汉“捡尸”猥亵，流浪汉被判刑两年

box-sizing: border-box;'>经常逛夜店的人，对一个叫“捡尸”的词语可能并不陌生。</p><p style='text-indent: 2em; box-sizing: border-box;'><strong>现实中就有这么一群人，夜间在酒吧里或酒吧附近蹲守，捡拾喝酒醉得像尸体、不省人事的女性，带至酒店或者僻静处，甚至公然就在路边进行猥亵、性侵等。这种极其龌龊、涉嫌违法犯罪的行为，被称为“捡尸”，还有的称为“捡死鱼”等。</strong></p><p style='text-indent: 2em; line-height: 2; box-sizing: border-box;' powered-by="xiumi.us"><p style='text-indent: 2em; box-sizing: border-box;'><span style='text-indent: 2em;'></span><span style='text-indent: 2em;'>你别说，先请看发生于罗湖的这宗案例：</span></p><p style='line-height: 2em;text-indent: 2em;'>2021年3月1日凌晨，在深圳某公司工作的年轻小伙子阿仁，和几个朋友在酒吧玩得很尽兴，喝得醉熏熏后，各自返回住处。走到黄贝岭一带，阿仁酒劲上涌，坐在路边休息，慢慢就倒了下去，“断片”后不省人事了。</p><p style='line-height: 2em;text-indent: 2em;'>这时，已是凌晨两三点了，一名流浪汉，王某，从附近经过。</p></section><section style='font-size: 16px; line-height: 2; box-sizing: border-box;' powered-by="xiumi.us"><p style='text-indent: 2em; box-sizing: border-box;'><br></p><p style='line-height: 2em;text-indent: 2em;'>王某一直没有固定工作、固定住处，偶尔有机会就打个短工，大部分时间都在四处流浪，还曾因盗窃被判过刑。这次流浪中看到有名男性醉卧路边，身为男同性恋者的王某，上前一看，邪念顿生，心中一喜。于是，他扶起醉得一塌糊涂的阿仁，就近到一小宾馆，花200元开了房。</p><p style='line-height: 2em;text-indent: 2em;'><br></p><p style='text-align: center;margin-bottom: 0em;'><span class="wxart_image" wx-style='display:inline-block;width: 181px;height: 165px;'></span></p><p style='text-align: center;margin-bottom: 0em;'><br></p><section style='line-height: 2em;text-indent: 0em;text-align: center;'></section><p style='line-height: 2em;text-indent: 2em;'>进了房间，王某将阿仁扶到床上，就将阿仁的裤子内裤褪下，进行各种猥亵。按王某事后的供述，他准备对阿仁先猥亵、等下再性侵的。</p><p style='line-height: 2em;text-indent: 2em;'>随着时间的推移，阿仁迷迷糊糊中，慢慢得逐渐有了一点意识，待他看到自己裤子被褪下，一个邋里邋遢、不修边幅的陌生男人趴在其两腿之间对其猥亵时，不禁大惊，酒都吓醒了一半，“你是谁？在干吗？”见对方怔住了没有回答，阿仁拉上裤子冲出房间，来到宾馆的前台找到服务员：他是个变态，快，快帮我报个警！</p><p style='line-height: 2em;text-indent: 2em;'><br></p></section><section style='font-size: 16px; line-height: 2; box-sizing: border-box;' powered-by="xiumi.us"><p style='line-height: 2em;text-indent: 2em;'><br></p><p style='line-height: 2em;text-indent: 2em;'>民警很快来到现场，将王某，以及愤怒中依然惊魂未定的阿仁，带走调查。</p><p style='line-height: 2em;text-indent: 2em;'>王某对其将醉酒的阿仁扶至宾馆开房进行猥亵、并意图进一步性侵的犯罪事实，供认不讳。更让阿仁惶恐的事，王某还患有严重的性病，为此，阿仁还赶紧到医院进行检查治疗等，花费了三千余元。</p><p style='text-indent: 2em; line-height: 2; box-sizing: border-box;' powered-by="xiumi.us"><p style='line-height: 2em;text-indent: 2em;'>检察官经审查后认为，王某以其他方法强制猥亵他人，其行为触犯了《中华人民共和国刑法》第二百三十七条第一款，犯罪事实清楚，证据确实、充分，应当以强制猥亵罪追究其刑事责任。2021年5月，罗湖区检察院以强制猥亵罪，依法对王某提起公诉。阿仁也向法院提起了附带民事诉讼。</p><p style='line-height: 2em;text-indent: 2em;'>后来，法院根据检察机关的量刑建议，以强制猥亵罪判处了王某有期徒刑两年，并赔偿阿仁医疗费用3370元。王某对此认罪服判，判决已生效。</p></section><section style='font-size: 16px;
