渭南一市民花22万买辆二手奥迪车，未料竟是“问题车”

line-height: 1.6em; margin-bottom: 8px; margin-top: 8px;'><span style='font-size: 16px;letter-spacing: 1px;'>针对此事记者还咨询了律师，赵良善认为：豪杰车行是否构成消费欺诈，关键要看豪杰车行是否明知该车辆是事故车，如果豪杰车行通过系统无法查询到该车辆的事故信息，自身确不知情该车辆是事故车，那么豪杰车行不存在主观故意，不构成消费欺诈，不需要承担退一赔三的赔偿责任。相反，如果豪杰车行通过系统能够查询到该车辆的事故信息或者原车主曾告知该车辆是事故车，而豪杰车行刻意隐瞒车辆存在事故这一事实，则构成消费欺诈，根据《消费者权益保护法》第55条规定：“经营者提供的商品有欺诈行为的，应当增加赔偿消费者受到的损失，增加赔偿的金额为消费者购买商品的价款的3倍；增加赔偿的金额不足五百元的，接五百元赔偿。”，豪杰车行需承担退一赔三的赔偿责任。</span></section><section style='color: rgb(34, 34, 34);
