size="4">（一）违规异地执法问题。超越地域管辖权限，擅自到异地开展执法检查、办案；未履行案件移送、执法协作程序，争抢案源、跨区域处罚；以联合执法、协查为名变相异地办案、趋利办案等。</font></span></p><p data-mpa-action-id="mifuh1v7ho6" data-pm-slice="0 0 []" size="4">（二）趋利性执法问题。下达或变相下达罚没收入指标、罚款任务；将罚没收入与单位经费、人员考核、绩效奖励挂钩；为完成任务选择性执法、钓鱼执法；截留、挪用罚没款，违规管理罚没财物。</font></span></p><p data-mpa-action-id="mifuh1v7ho6" data-pm-slice="0 0 []" size="4">（三）乱收费问题。无法律法规依据向企业、个体工商户收取任何费用；借登记、年检、抽检、认证、培训等搭车收费；违规要求企业赞助、摊派、订购报刊、加入协会并收费；下属单位、协会、中介机构及其他市场主体谎称商品和服务价格为政府定价或政府指导价而违规收费。</font></span></p><p data-mpa-action-id="mifuh1v7ho6" face="微软雅黑" size="4">（四）乱罚款问题。无法定依据、超越法定权限实施罚款；不执行行政处罚裁量基准，随意裁量、小过重罚、类案不同罚；以罚代管、只罚不管、重复处罚；对符合“首违不罚”“轻微免罚”情形仍予以处罚；罚款不开具法定票据、罚缴不分离等现象。</font></span></p><p data-mpa-action-id="mifuh1v7ho6"
