line-height: 1.6; letter-spacing: 0.034em; visibility: visible;'>2021年3月1日起施行的刑法修正案（十一）规定，已满十二周岁不满十四周岁的人，犯故意杀人、故意伤害罪，致人死亡或者以特别残忍手段致人重伤造成严重残疾，情节恶劣，经最高人民检察院核准追诉的，应当负刑事责任。针对司法实践中关于“犯故意杀人、故意伤害罪”是指具体罪名还是犯罪行为的争议，《规定》进一步将其明确为“实施故意杀人、故意伤害行为”，防止因罪名认定障碍导致严重暴力犯罪无法追责，实现了宽严相济刑事政策的精准贯彻。<span textstyle='' style='color: rgb(123, 12, 0);font-weight: bold;'>《规定》要求坚持双向保护原则，既要保护未成年犯罪嫌疑人的合法权益，也应当加强对被害人的权益保护，并且注重维护社会秩序和公共利益。</span></span></p><p><span leaf="" style='color: rgba(0, 0, 0, 0.9);
